Brandon Seyboth Audio Sound Library End User License Agreement
In purchasing or using in any way any of Brandon Seyboth’s (“Licensor/Me/I/My”) sound effects libraries (“libraries/Sounds”), the purchaser (“You/Licensee”) agrees to be bound by the terms and conditions of this license agreement (“Agreement”). If you do not agree with these terms and conditions, do not purchase or use any of my libraries.
What your purchase entails:
When you purchase any of my libraries, the sounds within are licensed, not sold, to you. This non-exclusive royalty-free media license is granted to one user; if you would like a multi-user license, contact me directly. The license grants you the right to use the sounds anywhere in the world, as many times as you would like, for as long as you continue to metabolize, provided they are used in a manner allowed by this agreement.
What the License allows you to do:
The license grants you the rights to:
-Synchronize the sounds with other visual or audio elements as part of a film, video game, internet, television, music, or other media production/project.
-Reproduce the sounds/transfer the sounds to a medium for distribution (DVD, Blu-Ray, digital download, etc), but solely as part of that production/project.
-Publicly perform or broadcast the sounds, but solely as part of that production/project.
What the License does not allow you to do:
Any use of my sounds other than those listed above would be considered an unauthorized use of my sounds. This would mean that you are not permitted to:
-Use the libraries on more than one workstation, unless a multi-user license is purchased
-Claim ownership of the sounds
-Sell/license/redistribute any library in any way, shape, or form, other than as part of a production (as detailed in the preceding section), in whole or in part (such as combining it with another sound effects library, putting it in a sound effect playback system or a sample instrument, etc.), without written permission from me.
-Allow access to/use of any library by anyone other than someone who holds a license to the library/libraries in question.
-Sell, or transfer in some way a hard drive or other storage medium that contains any of my sounds (except as part of a production, as detailed by #2 in the preceding section), as this would be redistribution of the sounds. You can, of course, delete them from the storage medium beforehand.
-If you are unsure as to whether something is considered an authorized use of my sounds, feel free to email me your questions.
Copyright of my sounds and libraries is owned by me, and other than the rights granted to the licensee by this agreement, I retain all rights to the sounds.
You will indemnify me from and against any and all third party demands, suits, liabilities, claims, damages, and all expenses, including without limitation legal fees suffered by me that arise as a result of a breach or alleged breach of this agreement by you.
The license(s) and the rights it/they provide(s) to you are automatically forfeit upon violation of this agreement. In such an event, you must quit using the libraries and obliterate all existing copies of the libraries in your possession.
I am not liable in any way for any loss of profits, loss of business or any other loss of any kind that results or is perceived to result, directly or indirectly, from the use of any of my libraries.
No refunds, as digital goods cannot be returned. If you have some kind of issue, however, contact me, I’ll see what I can do.
This agreement will be governed by the laws of the state of Oregon, U.S.A.
